Terms and Conditions

1. SCOPE OF AGREEMENT

I hereby employ Wilkins Casting Agency Ltd as my talent agency on a non-exclusive basis.

2. DURATION AND TERM OF AGREEMENT
This contract is for a period of one year from the date this contract has been signed hereof.

2.1. I authorise Wilkins Casting Agency Ltd to negotiate contracts for the rendition of my professional services as an artist, or otherwise, in the fields of motion pictures, modelling, legitimate stage, radio broadcasting, television, speaker engagements, literary works and other professional artistic services booked through Wilkins Casting Agency Ltd.

2.2. This contract will automatically renew in one year unless either party terminates the agreement in writing.
2.3. I acknowledge that Wilkins Casting Agency Ltd will act under the guidelines of this Talent Agency Contract on behalf of anyone I refer to Wilkins Casting Agency Ltd for any opportunity, audition or booking.

3. DUTIES OF THE TALENT

3.1. When contacted for a booking request, I will respond to the Wilkins Casting Agency Ltd representative in a timely fashion.
3.2. I will not accept a booking if I am not available, if my circumstances change and I can no longer attend a booking I have accepted, I will inform Wilkins Casting Agency Ltd as soon as possible.

3.3. I understand that failure to show or to notify the agency of this may result in instant dismissal due to breach of contract.
3.4. It is the responsibility of the talent to inform Wilkins Casting Agency Ltd of any drastic changes in appearance as this may mean a booking being cancelled due to a difference between the image we have for you on our website to your true likeness.

3.5. I agree to arrive at the requested time for bookings / auditions I have been confirmed for.
3.6. If a self tape is required for an audition, I agree to return this at my earliest convenience as this may delay in being cast for a particular booking.
3.7. Any issues I may have whilst working on a booking, will be addressed to a representative of Wilkins Casting Agency Ltd and not with the client.

4. DUTIES OF THE AGENCY

4.1. Wilkins Casting Agency Ltd shall remain obligated to serve me and perform obligations with respect to said employments or to extensions or renewals of said contracts or to any employment requiring my services on which such compensation is based.
4.2. I understand that Wilkins Casting Agency Ltd will be the Talent Agency of record on any such booking and will be paid agency commissions as per this contract appropriately.

4.3. I hereby agree that Wilkins Casting Agency Ltd may advise, counsel or direct me in the development and /or advancement of my professional career.
4.4. Wilkins Casting Agency Ltd will not accept any engagements for Talent without Talent’s prior approval, which shall not be unreasonably withheld.
4.5. Wilkins Casting Agency Ltd shall fully comply with all applicable laws, rules and regulations of government authorities and secure such licenses as may be required for the rendition of services hereunder.

5. PAYMENT TERMS

5.1. Payment for any work sourced by Wilkins Casting Agency Ltd for the talent will be paid via BACs to the talents’ nominated bank account once payment is received and cleared in to the account of Wilkins Casting Agency Ltd from the Client.
5.2. Talent fees typically come to the agency. However, if I receive any monies directly from a client that I have been booked to work with via Wilkins Casting Agency Ltd, I will immediately forward the monies via cheque/ BACs to Wilkins Casting Agency Ltd and will receive a BACs in return for the amount due me as talent.

6. AGENCY COMPENSATION

6.1. I hereby agree to Wilkins Casting Agency Ltd deducting a sum equal to twenty percent (20%) of all monies that have been received on work that Wilkins Casting Agency Ltd have booked on my behalf.

6.2. I acknowledge that the compensation payable to Wilkins Media Ltd hereunder is in addition to any service fee Wilkins Casting Agency Ltd might or shall receive from the client for whom I render services and said sum shall not reduce the commission payable to Wilkins Media Ltd by me hereunder. 

6.3. For agreements that cover the travel expenses of the talent, no commission will be deducted from this amount and I may receive this expense prior to the booking if client pays said amount upfront. I will provide receipts at the request of the client and/or Wilkins Casting Agency Ltd for travel expenses covered in agreements. 

6.4.  An admin fee of £42 will be taken from the net pay of the first job booked through Wilkins Casting Agency Ltd. This amount is on a one-off basis and will cover the processing of personal details and right to work checks. (ARTISTE DIVISION ONLY) - Young Performers Division will be £40 split over first 4 bookings

6.5.  Subsequent work booked will refer to the 20% commission basis plus a £2 book fee. The book fee is to cover the agency system charge applied to each booking. (ARTISTE DIVISION ONLY) - Young Performers Division will be 20% commission and no book fee will be taken.

6.6.  Failure to adhere to any of the duties of the talent will result in instant dismissal from the agency due to breach of contract. No suspension period will be applied prior either. 

7. PERMISSIONS

7.1. Wilkins Casting Agency Ltd is authorised and empowered by me to approve and permit the use of my name, photograph, likeness, video footage, voice and theatrical materials in connection with my services in the entertainment industries as outlined above in connection with those uses, purposes and projects with I have specifically authorised said use.
7.2. Wilkins Casting Agency Ltd is authorised to sign photographic and other releases for me consistent with the terms and provisions of this Agreement and any specific project or booking.

7.3. Wilkins Casting Agency Ltd is specifically empowered, consistent with these provisions, to endorse cheques to Wilkins Casting Agency Ltd account and payment to me pursuant to this Agreement.

8.INVOICING

8.1. Wilkins Casting Agency Ltd is further authorised to contract for, bill, collect and receive sums payable and derived from my services, and upon receipt of the sums, to deposit them in Wilkins Casting Agency Ltd accounts, directly, and to deduct therefrom all sums owing to Wilkins Casting Agency Ltd pursuant to this Agreement.

9. LITIGATION PROCESS

9.1. Controversies arising between client and Wilkins Casting Agency Ltd shall be referred to the solicitor of Wilkins Casting Agency Ltd and legal proceedings be initiated on the talents behalf.
9.2. Wilkins Casting Agency Ltd will make efforts to procure employment for me in the field or fields of endeavour specified in the contract in which you represent me.

10. RELATIONSHIP TO PARTIES

10.1. The parties hereto agree, and I acknowledge, that I am employed through the agency, not by the agency.
10.2. This contract and the relationship between the parties does not constitute employment. I understand that I am on a self-employed basis and I am responsible for all tax contributions, NI and insurance owed upon my earnings.

11. PRIVACY POLICY
11.1. INFORMATION WE COLLECT ABOUT YOU

Wilkins Casting Agency Ltd generally collects some or all of the following personal information about you when you access our web site, submit an application for our consideration or when you are in contact with a Wilkins Casting Agency Ltd representative:
Your name including any use of a pseudonym;
Your address and contact details;
Your employment history;
Your bank account details and National Insurance Number;
Referee opinions;
Interview opinions; and
Any other information that you have supplied on your application or in
communications with a Wilkins Casting Agency Ltd representative.

11.2. OBTAINING YOUR INFORMATION

We obtain most of your personal information directly from you, for example:
When you access our site;
When you submit your application to us; and each time you communicate with a Wilkins Casting Agency Ltd representative (by phone, fax, email or in person).
We also collect some of your personal information from third parties including:

Employment websites & apps; Reference checks with referees; and Networking with your peers.

11.3. WHY WE COLLECT YOUR PERSONAL INFORMATION

Wilkins Casting Agency Ltd collects personal information about you to carry out its business functions and Fulfil its obligations to you, including in relation to:
Determining if you are suitable for a role;
Contacting you if a role becomes available that you may be interested in;

Submitting your details to a client for a potential role;
Notifying clients of your skills and availability for any future roles;
Complying with government legislation (for example: we collect your National Insurance number to complying with taxation and superannuation requirements);
Administration of payments to you, which may include the processing of sensitive information about you and marketing activity
Inform you of work opportunities or other events such as training or information sessions Providing you with the opportunity to obtain benefits through direct marketing
(however you will always be given an opt-out option in relation to further direct
marketing).
In addition, Wilkins Casting Agency Ltd may occasionally be required by law to collect, use and disclose your personal information, for example in order to comply with the requirements of government departments for business data.
Use and disclosure of your personal information

11.4. WHO YOUR PERSONAL INFORMATION MAY BE DISCLOSED TO

Prospective employers or entities seeking to fulfil roles (this may also include your buy rate if Wilkins Casting Agency Ltd is operating under a preferred supplier agreement);
Staff of the departments responsible for administering the processes described above;
Third parties such as agency partners for the purpose of direct and indirect marketing;
Partners or suppliers for the purpose of research, development, business systems and infrastructure testing and other business purposes to assist us in providing our services to you; and Related bodies corporate and third parties for the administration and provision of selected benefits and services (for example: training and superannuation).

We do send information overseas. Sometimes, we transfer or disclose information to third parties including to persons and businesses outside jurisdictions Talent operates in. These transfers are made in order to assist us to provide you with the products and services, and/or to improve the products and services we offer you. Where we transfer information to persons outside our operating jurisdictions we take reasonable steps to ensure that the recipients of such information do not breach the UK Privacy Principles, where appropriate the GDPR and other laws in relation to that information by entering into binding contractual arrangements with such third parties

11.5. HOW TO ACCESS, CORRECT or UPDATE YOUR PERSONAL INFORMATION

Wilkins Casting Agency Ltd relies on the accuracy of the personal information you provide to us. To the extent authorised by the UK Privacy Act, GDPR and other applicable laws, you can access and amend your personal information held by Wilkins Casting Agency Ltd.
If you wish to request access to, find out more about or seek amendment of your personal information held by Wilkins Casting Agency Ltd, you should contact the Privacy Inquiry Service (contact details below).

11.6. SECURITY OF YOUR PERSONAL INFORMATION

Wilkins Casting Agency Ltd will take reasonable steps to ensure that we hold your personal information in a secure environment accessed only by authorised persons for approved business purposes.

However, no data transmission across the internet can be guaranteed to be 100% secure. While we strive to protect your personal information from misuse, loss and unauthorised access, we cannot guarantee the security of any information you transmit to us or receive from us across the internet. These activities are conducted at your own risk. Once we receive your transmission we make our best effort to ensure its security.

In the event of a data breach, Wilkins Casting Agency Ltd are committed to complying in all respects with the requirements of all UK Privacy Laws and where required, the provisions of the GDPR in relation to our privacy policy.

11.7. PRIVACY INQUIRY SERVICE

Report any relevant notifiable data breach you may become aware of;
Obtain a copy of the Wilkins Casting Agency Ltd Privacy Policy;
Request access to, find out more about or seek amendment of your personal information held by Wilkins Casting Agency Ltd;

Inquire generally about your privacy rights and obligations;
Provide suggestions or feedback in respect Wilkins Casting Agency Ltd handling of personal information;
or make a complaint in relation to Wilkins Casting Agency Ltd handling of your personal information.

11.8. CONSENT
By signing this contract . You consent to the collection, use and disclosure of your personal

information.

12. ENTIRE AGREEMENT.

This instrument constitutes the entire agreement between us and no statement, promises, or inducement made by any party hereto that is not contained herein shall be binding or valid, and this contract may not be enlarged, modified, or altered, except in writing by both the parties. Wilkins Casting Agency Ltd will deliver / provide directly to the client an executed exact copy of this contract.

If you do not have to time to complete, we advise you coming back when you do. We reserve the right to decline multiple applications made for one person.

If you have been removed off the roster for breach of contract within the past 12 months, you will not be eligible to re-join during this period. We may consider your application after this timeframe but we cannot guarantee you will be accepted.
